Spanish pension in Colombia: where is it taxed?

If you receive a Spanish pension and have moved to Colombia, you may wonder whether you must pay tax in Spain, Colombia, or both. There is no single answer for every pension. The outcome depends on your tax residence, the nature of the pension, and the Spain–Colombia double taxation treaty.

Does living in Colombia mean you pay tax there?

Not necessarily. The first step is to establish whether you are tax resident in Colombia and whether you have ceased to be tax resident in Spain. Changing your address or having your pension paid into a Colombian bank account does not, on its own, settle the question.

Spain considers factors including the time you spend in the country, the location of your main economic interests and certain family circumstances. If both countries regard you as tax resident, the treaty provides rules for resolving that conflict.

Does the type of Spanish pension matter?

Yes. The treaty distinguishes, in particular, between pensions arising from previous employment and pensions paid for services rendered to the State or certain public bodies. Different rules can apply to each category.

Before deciding where to declare your pension, it is important to review the documents granting it and the work or services from which it arose. The identity of the organisation making the payment may not, by itself, provide the full answer.

What if tax is still withheld in Spain?

Spanish withholding does not necessarily mean that Spain has the final right to tax the pension. You may need to provide evidence of your Colombian tax residence and check whether the payer is applying the treaty correctly. A tax residence certificate issued by the relevant tax authority is an important document for this purpose.

What should you check?

Determining how a Spanish pension is taxed after a move to Colombia requires a review of:

  • Your tax residence during the year of the move.
  • The type of pension and the services from which it arose.
  • Your nationality, where the treaty makes it relevant.
  • Any tax withheld or declared in either country.
